Abstract
The principle of respect for the dignity of the detainee was established by the European Court of Human Rights in a major decision in the year 2000. This recognition gradually spread to French law until it was taken up again by prison law. For several years now, the European judge and the French judge have continued to clarify their case law to an extent never reached in 2020 and 2021.
